ADDITIONAL TERMS AND CONDITIONS

The “On This Bright Day” Bonus Gift offering (“Promotion”) is sponsored by BRIGHT LINE EATING SOLUTIONS, LLC, 620 Park Avenue, Suite 214, Rochester, NY 14692 (“Sponsor”). 

By entering your information to get your Bonus Gifts associated with pre-ordering “On This Bright Day” by Susan Peirce Thompson, PhD., you agree (a) to be bound by these Additional Terms and Conditions as well as any other terms and conditions that may apply to the Promotion including, without limitation, those set forth at the following URL:  https://www.brightlineeating.com/onthisbrightdaybook; (b) you are eighteen (18) years of age or older as of September 6, 2023; and (c) to be bound by the decisions of the Sponsor, which are final and binding on all matters relating to the Promotion.  The Promotion is void where prohibited and the Sponsor is not responsible for any typographical or other errors in the printing of the offer, administration of the Promotion, or the announcement of the prizes, or for lost, late, misdirected, damaged, incomplete or illegal entries.

SELECTION AND VERIFICATION OF WINNERS 

The Sponsor will tally up the entries on November 1, 2023, and winners will be announced later that day. In the event of a tie, the winner will be the person who reached the winning amount of books first by reporting it to Bright Line Eating. "Reaching the winning amount first" will be determined by the timestamp of the form submitted to Bright Line Eating and is determined regardless of actual date of purchase." All potential winners are subject to verification before any prize will be awarded. In the event that you win, you will be notified via email where you will receive specific redemption instructions. You must redeem the prize pursuant to the instructions to remain eligible. Sponsor reserves the right at its sole discretion to disqualify the entry of any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Promotion or any Sponsor website; or (b) violating these Additional Terms and Condition, conditions of use and/or general rules or guidelines of any Sponsor property or service. 

CAUTION

Any attempt by you or any other individual to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. 

ENTRIES TO WIN THE AUDIOBOOK & SIGNED BOOKPLATE

A random drawing will be conducted on November 1, 2023 by Sponsor to select the (10) winners from among all eligible entries received. Odds of winning depend on the number of entries received. Potential winners will be notified by email. In the event that you win, (a) you will receive specific redemption instructions via email and must redeem the prize pursuant to the instructions on or before November 8, 2023, and (b) but are later disqualified for any reason or do not otherwise accept the prize on or before the preceding date, Sponsor will award the applicable prize to an alternate winner by random drawing among all eligible entries.  Prizes are non-transferable and have no cash equivalent unless required by law. Sponsor reserves the right to substitute a prize for one of equal to or greater value if the designated prize should become unavailable for any reason.  Each audiobook and signed bookplate prize is valued at $15.

ADDITIONAL ELIGIBILITY FOR TRIP TO ROCHESTER  

In the interest of maintaining confidentiality and privacy with respect to the Sponsor and its owners, you will be required to execute a waiver, confidentiality agreement, and submit to a background check in order to redeem the trip to Rochester, NY.  Details will be provided upon verification that you are one of the top three (3) book purchasers.

RELEASE

You agree to release and hold harmless Sponsor, and each of their respective direct or indirect parents, subsidiaries, affiliates, related entities, suppliers, distributors, advertising/promotion agencies and each such entity’s officers, directors, members, employees, contractors, and agents from and against any and all losses, liability, illness, injury, claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt, possession, use or misuse of any prize.

PRIVACY

Information submitted in connection with the Promotion is subject to the Sponsor’s Privacy Policy located at https://www.brightlineeating.com/privacy-policy. 

LIMITATION ON LIABILITY

BY ENTERING THE PROMOTION, YOU WAIVE ALL RIGHT TO, AND HOLD THE SPONSOR HARMLESS FROM, ANY CLAIM, LIABILITY, LOSS, DAMAGE (INCLUDING PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES), OR EXPENSE (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH PARTICIPATION IN THE PROMOTION OR THE ACCEPTANCE, USE, OR MISUSE OF ANY BONUS GIFTS. SPONSOR WILL NOT BE RESPONSIBLE FOR: LATE, INCOMPLETE, OR INCORRECT ENTRIES; YOUR FAILURE TO RECEIVE PRIZE NOTICES DUE TO YOUR SPAM, JUNK E-MAIL, OR OTHER SECURITY SETTINGS OR FOR YOUR PROVISION OF INCORRECT OR OTHERWISE NON-FUNCTIONING CONTACT INFORMATION; TECHNICAL, HARDWARE, OR SOFTWARE MALFUNCTIONS, LOST OR UNAVAILABLE NETWORK CONNECTIONS, OR FAILED, INCORRECT, INACCURATE, INCOMPLETE, GARBLED, OR DELAYED ELECTRONIC COMMUNICATIONS WHETHER CAUSED BY THE SENDER OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR USED IN THE PROMOTION; BY ANY HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF SUBMISSIONS; OR ANY TYPOGRAPHICAL, TECHNOLOGICAL, OR OTHER ERROR IN THE PUBLISHING OF THE OFFER, ADMINISTRATION OF THE PROMOTION, OR ANNOUNCEMENT OF THE PRIZES. IF, IN THE SPONSOR’S OPINION, THERE IS SUCH AN ERROR, OR THERE IS ANY SUSPECTED EVIDENCE OF TAMPERING WITH ANY PORTION OF THE PROMOTION, OR IF TECHNICAL DIFFICULTIES (INCLUDING VIRUSES AND BUGS) COMPROMISE THE INTEGRITY OF THE PROMOTION, SPONSOR RESERVES THE RIGHT IN ITS SOLE DISCRETION, CANCEL OR MODIFY THIS PROMOTION IN A MANNER DEEMED APPROPRIATE BY THE SPONSOR. IN THE EVENT OF TERMINATION, WINNERS WILL BE SELECTED FROM AMONG ALL ELIGIBLE ENTRIES RECEIVED AS OF DATE OF TERMINATION. IN THE EVENT A DISPUTE ARISES AS TO THE IDENTITY OF A POTENTIALLY WINNING ENTRANT, ENTRIES WILL BE MADE BY THE NAME ON THE ONLINE ENTRY FORM.

CHOICE OF LAW AND FORUM

You agree that all matters arising out of or relating to the Promotion and these Additional Terms and Conditions are governed by, and construed in accordance with, the laws of New York, without giving effect to any of its conflict of laws provisions thereof. You further agree that any legal suit, action, or proceeding arising out of or relating thereto shall be brought exclusively in the applicable federal or state courts located in Monroe County, New York.
